The following terms and conditions apply to all transactions on our website. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. Calls may be monitored for quality control and training purposes. Your statutory rights are not affected.
1. Description of Goods
All of the products that we sell are of a technical nature therefore it is not practical to publish detailed specifications of all products. All images, descriptive matter, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods. All specifications given to the Customer are approximate and intended as a guide only. We do not accept responsibility for any preparation work based on such specifications.
2. Accuracy of Product Information
All product specifications, images and other information published on our website have been made accessible by suppliers and manufacturers. Our intention is that all information on the website should be as accurate and up to date as possible. However, we cannot guarantee the reliability or the accuracy of the information contained within its pages. We reserve the right to change product specification without prior notice.
3. Payment and Price
The total price payable for the goods will be stipulated at the time you place your order whether or not the order has been confirmed. All prices on the Bathroomsni website are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time of placing your order, unless stated otherwise.
4. Our contract and Acceptance of your Order
When you place an order to purchase a product from Bathroomsni, we will send you an e-mail confirming receipt of your order and containing the details of your order. There will be no contract of any kind between you and us until payment for the goods is authorised by your Credit Card Company. If for any reason beyond our reasonable control, we are unable to supply a particular item we will notify you as soon as possible. We retain the right to refuse any sale at our sole discretion.
5. Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them.
6. Payment Methods
We accept all major credit and debit cards including Visa, MasterCard and Switch. On the order you must provide us with your exact billing address and telephone number. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received.
7. Delivery Charges
The charges for our delivery service are not inclusive in the price. You are not required to use our delivery service and can arrange to collect the items from us and will therefore not incur a charge for our delivery service. The delivery charges will vary depending upon the product and service you select, which will be notified to you at checkout.
8. Acceptance of Delivery
As soon as we have delivered the goods to your door you will be responsible for them. We ourselves, or a suitable courier appointed by Bathroomsni will only deliver goods to the address on the order and goods will not be left without a signature. We accept no liability whatsoever in respect to late deliveries. Please check all items on delivery for damage. If any external damage is visible please note on delivery paper work and email us at email@example.com
The customer agrees to open all boxes and thoroughly check the goods for damage as soon as possible and notify us of any damage within 3 days of the delivery. If the package looks damaged then sign the paperwork with the word "damaged". If we are not notified of damage within 3 days we are unable to claim from either the manufacturer or the carrier. You agree to indemnify us in full for any losses we suffer as a result of your failure to notify us within 3 days. For bulky deliveries that arrive on pallets you agree to check the goods for visible transit damage before signing the driver’s delivery note. If you sign for the goods, even if you write the words "Unchecked" or similar on the delivery note, then you are accepting that the goods arrived without obvious external damage to the packaging and later claims for carrier damage will not be considered. If the driver refuses to wait while you check the goods then you must refuse to accept the delivery.
9. Product Guarantees
All products supplied are guaranteed for a period of 12 months. This guarantee specifically excludes faults caused by accident, neglect, misuse or faults that cannot be confirmed as not resulting from incorrect installation. In addition routine maintenance, if needed, is not covered.
For the avoidance of doubt if the manufacturer becomes insolvent you accept that the additional guarantee is lost. In many cases the manufacturers provide after sales service engineers who will call or visit your house to fix any problems that you may have with their products. In the event that you are not satisfied with the service they provide then please contact us and we will endeavour to resolve any problems for you.
This does not affect any statutory rights that you may have.
10. Delivery Dates
We are proud of the reputation we have for the high quality and timely delivery service we provide. However, please note that all delivery dates given are always provisional. We must stress even with a confirmed delivery date, you are strongly advised not to pre-book contractors, or engage in any preparatory work until such time as you have all your goods and are happy that they are correct as ordered and damage free. We accept no liability whatsoever in respect to late deliveries.
If goods are faulty, following confirmation by the manufacturer (this will require a telephone call or home visit by a manufacturer representative or engineer) you may return the product free of charge. A full refund will be made back to the account originally charged for the purchase of the product.
11.1 Returns & Re-stockage
If you change your mind and which to return items from your order, you must email firstname.lastname@example.org - only unopened goods in their original packaging will be considered for return. If we agree to the return there will be a re-stockage charge of 25%. Please note specially ordered items or non stock items will not be accepted for return. The customer must ensure that the goods are returned at their expense in a re-sellable condition and make sure that the return delivery is fully insured against damage in transit. If goods are returned and are damaged in transit then we will refuse the goods and no refund will be issued.
12. Pricing Errors
In the event that there is a pricing error on our website then Bathroomsni.co.uk will not be bound to honour any orders made at that price.
13. Delivery of Goods
The delivery of goods to you is deemed to be a separate contract for services, distinct from your contract to purchase the goods. This is because we use various couriers to deliver the items to maintain as competitive a price as possible. If an item on a delivery is damaged, make a note of the damaged item on the delivery paperwork and email email@example.com without delay with the details. Do not refuse the delivery unless every item is damaged. If you refuse a delivery with any undamaged items on it you will be charged for the return and the redelivery of those items.
For large pallet deliveries please be aware that the costs will be considerably higher than the fee you are charged for delivery. The delivery drivers are not insured to take their vehicles on roads other than public highways. If you live in a remote location and your home is not on a public road, e.g. If you live at the end of a farm track or up a very narrow lane which the couriers vehicle cannot access then the driver will deliver the goods to the end of the public road only. You accept this when placing your order and if you refuse the delivery because of the driver cannot drop at your door then you will be charged the actual delivery costs and collection fees.
14. Cancellation of Contract
You will be entitled to cancel your Contract with us in the following circumstances:
14.1 Where goods have not been installed and you are unhappy with the goods for whatever reason, and notify us before the expiry of 7 days from the day after the day on which the goods were received; or
14.2 Where the goods supplied are faulty or not in accordance with the specifications of your order.
14.3 A refund will be reimbursed to you within 28 days from the day after the day on which the cancellation was made. This is subject to us being given reasonable opportunity to collect, inspect and confirm the goods are in acceptable condition for return.
14.4 This right of cancellation does not apply to special orders of products or goods not featured on our website or, if featured on our website, not held in stock by us at the time of placing your order, or where goods are specifically made to your specification or personalised at your request.
14.5 After 7 days from the day after the day on which the goods have been received, we reserve the right to levy a re-stocking charge equivalent to 20% of the value of the items returned. After 14 days you will not be able to cancel the contract.
14.6 All goods must be returned unused and in their original packaging.
14.7 We cannot refund the value of goods that have been damaged while in your possession, care or control.
